The Ellettsville, Indiana, Town Council met in regular session at 7:30 p.m., Monday,† December 22, 1997. Members present were Michael Cornman, President, Geraldine McIntyre, Vice President, Donald Ashley, and Patrick Stoffers. Mr. Cornman called the meeting to order.† Donald Ashley gave the prayer.
MINUTES AND CLAIMS:
Mike Cornman asked is there a motion to approve the minutes and claims.† Geraldine McIntyre so moved.† Donald Ashley seconded.† Motion passed 4-0.
Mike Cornman said we have a special claim for SRF this request is pay #59 Reynolds Inc. for $29,255.† Mike Cornman asked if there was a motion to approve this SRF fund.† Donald Ashley so moved.† Geraldine McIntyre seconded.† Motion passed 4-0.
ORDINANCE 97-15 TO AMEND ORDINANCE 96-11 FIXING OF SALARIES:
The Clerk informed the Council this is for the 27 pays and this is a 2nd reading.

CHANGE ORDERS FOR ELLETTSVILLE WWTP FACILITY:
Gary Miller asked the Council if they have a copy of the change order.† Mike Cornman said 8 and 19, he has his.† Gary said basically this change order, the open building with sides open that sits next to the equipment building, that is where we are going to store the sludge.† The plans didnít clearly show materials that were going to be put on the gables of that building.† They put out a RFP 19 to -----them a price to include that with additional items.† The cost is $3,480.† Rick said it will make the building last longer and protect it.
There was discussion on this.
Mike Cornman asked if there is a motion to accept the change orders.† Donald Ashley so moved.† Geraldine McIntyre seconded.† Motion passed 4-0.
RESOLUTION 16-97 TRANSFER OF FUNDS:

ORDINANCE 97-17 ORDINANCE TO AMEND SECTION 255-10(B) AND C OF THE ELLETTSVILLE TOWN CODE CONCERNING PERSONNEL:

PSI CONTRACT FOR SPRINGS VALLEY:
This is for one street light in Springs Valley.† Mike Cornman said is there a motion to approve the street light in Springs Valley.† Geraldine McIntyre so moved.† Don Ashley seconded.† Motion passed 4-0.
AGREEMENT CASSADY AND COOK-MIKE SPENCER:
Mike Spencer said what we have done is they have negotiated with Cook Inc. and Cassadyís.† It incorporates most of the request you had to achieve.† The agreed entry provides that for the easements, water easement and the .36 the Council will give to Cassady 44 hook ons and pay $20,000, that is the agreement.† We will be getting a deed for the .36 acres.†
There was more discussion with the Council and Mike Spencer.
Mike Cornman asked Mike Spencer what is the process at this point as far as time wise, if we were to approve this tonight and we say with the holding of exhibits 11 and 12, and donít release until you have exhibits 11 and 12.†
Mike Spencer said essentially what he wants you to do is approve that agreement.† Mike Spencer said then he wants you to separately instruct him to hold them, he doesnít think that should be part of the motion, you should instruct him separately to hold on to the agreement until he gets the 2 exhibits, he canít send it to Judge Johnson for his approval if the exhibits arenít attached, that is----of the agreed entry, almost by definition he canít do it he wants them to instruct him not to.† The process is once he gets the agreements, he will send a subpeona to Cook and they are going to accept the subpeona service.† He is actually going to prepare for Carol Seaman her appearance, so she can have her appearance.† He is going to send that with the documents.† Everything is going to be before the judge, he is going to call the judge.† Mike Spencer explained more to the Council.
Mike Cornman asked is there a motion to approve this-------entry?†† Patrick Stoffers so moved.† Motion passed 3-1, Donald Ashley voted no.
Mike Cornman instructed Mike Spencer to hold 11 and 12.
OPERATIONS AGREEMENT WITH TOWN OF ELLETTSVILLE WASTE WATER TREATMENT FACILITY AND THE WATER DISTRIBUTION AND THE
SANITARY SEWER COLLECTION SYSTEM:
Mike Cornman said based on the town attorney suggestion he will ask for a motion to approve the operations agreement with the Town of Ellettsville Waste Water Treatment facilities and the water distribution and the sanitary sewer collection system with Bynum Fanyo Utilities.† Is there a motion to that effect (problem with the tape)† Geraldine McIntyre made the motion Patrick Stoffers seconded.† Motion 3-1, Don voted no.
POLICE APPOINTMENT-STEVE BARTLETT:
Steve Bartlett wants to appoint Alvie Bohall to full time police officer, replacing Eric Chaudions position.† Mike Cornman doesnít see any problem, he is going from part time and he was a reserve officer before.† There was discussion. (tape problems)
Mike Cornman asked is there a motion to approve the full time status for Alvie J. Bohall.† Donald Ashley so moved.† Patrick Stoffers seconded.† Motion passed 4-0.
FIRE DEPARTMENT APPOINTMENT-JIM DAVIS:
Jim Davis wants to move Kevin Patton from Limited Full time to full time position with the fire department.† His wife works at IU and has insurance.† In case Kevinís wife would lose her job he would like to go on towns insurance.† There was discussion. (tape problems)
Mike Cornman asked, is there a motion to bring Kevin Patton from Limited Full time to full time, with this letter here that he does not request the health insurance.† Geraldine McIntyre so moved.† Patrick Stoffers seconded.† Motion passed 3 for and† Mike Cornman abstained from voting.
Jim Davis informed the Council that they have a Blazer they received from DNR to be used as a medical truck for Station 8, it is 2/3 done.
TRANSFER OF UNUSED VACATION DAYS TO SICK DAY ACCOUNTS:
Mike Cornman informed the Council that they have received request to transfer unused vacation days to sick days.† Those make the request are Ronnie Vandeventer, Louise Emmons, Kay Neal, Mike Cornman, Jim Davis, and Kevin Patton.
Mike Cornman asked is there a motion to allow them to convert the unused vacation days to their unused sick days?† Patrick Stoffers so moved.† Donald Ashley seconded.† Motion passed 3 for and Mike Cornman abstained.
ENCUMBRANCE LIST FOR 1998:
The Clerk-Treasurer wansts to add the encumbrance list to the minutes, State Board of Accouncts wants this done.† This is okay with the Council.

WATER SOFTNER-WASTE WATER TREATMENT PLANT:
Jeff Farmer informed the Council due to the hard water they have from Patricksburg water they need a water softener.† He called Culligan and he can rent for $45 a month or purchase for around $2,000.† They have already had to get new filters because of the hard water.† Geraldine wondered about running our own water out there.† Rick informed her the closest place is Horse Shoe retreat.† Jeff informed the Council that the plant is running wonderful.† The Council voted for them to purchase the Culligan.
