The Ellettsville, Indiana Plan Commission met in regular session at 7:00 p.m., Thursday, June 6th, 2002. Members present were Frank Buczolich, President, David Drake, Vice-President, William Evans, Secretary, Geraldine McIntyre and Don Calvert. Deborah Hudson arrived late. Frank Buczolich started the meeting by leading everyone with the Pledge of Allegiance. Terry Baker came in late.

NEW BUSINESS: A Petition to Vacate an Alleyway between Lots 5 and 6 of the Original Plat of the Town of Ellettsville
REF: Mr. Grover E. Brashear, 702 W. Main Street, P. O. Box 336, Ellettsville
Frank Buczolich asked Mr. Brashear to explain what he requested from the Planning and Zoning Board. Mr. Brashear gave a brief history of the property and explained he would like to improve his property. David Drake explained that Mr. Brashear actually had three problems that he needed to deal with to solve all of the issues about his property and the construction on the shed. David said the only thing the Planning Board would be dealing with tonight was the issue of if the Board refused or recommended to the Town Council that the Town vacate the alleyway.
David went on to explain that according to the Town’s Engineer Mr. Brashear wanted to add a bedroom to a shed and create a garage apartment. David said that this would not be allowed in a Residential 1 Zone because a person can only have one dwelling unit per parcel of land. David said in order for Mr. Brashear to do this he would have to file an appeal with the Board of Zoning Appeals to see if they would allow Mr. Brashear to differ from the standard (regulations) by giving him a waiver (variance).
David said the other problem Mr. Brashear has to resolve is that according to a survey that was done a couple of years ago, this shed is actually partially built on to someone else’s property. He said that Mr. Brashear would have to work out this issue with the other property owner(s).
David Drake made a motion to recommend to the Town Council to vacate the alleyway between lots 5 and 6 of the original plat of the Town of Ellettsville. Don Calvert seconded. Frank Buzcolich explained that when an alleyway is vacated it is split between the neighboring property owners, therefore, only half of it will be Mr. Brashear’s which is according to State Law, the Board has no control of that point. Motion carried 5-0. It will now go before the Town Council for their vote.
