The Ellettsville, Indiana, Town Council met in regular session at 7:30 p.m., Monday, March 22, 1999.Members present were Michael Cornman, President, Geraldine McIntyre, Vice President, Donald Ashley, Gina Hawkins and Patrick Stoffers. Mr. Cornman called the meeting to order.Donald Ashley gave the prayer, which was followed by the Pledge of Allegiance.

MINUTES AND CLAIMS:

 

Mike Cornman said is there a motion to approve the minutes and claims.Donald Ashley so moved.Geraldine McIntyre seconded.Motion passed 5-0.

 

OLD BUSINESS:

 

APPROVAL OF NEW TOWN MARSHAL BADGES:

 

Ron McGlocklin said as of the Excutive Order that was sent down 98-02.They have priced the Marshal and Deputy Marshal badges.He has a breakdown of 2 badges apiece for 8 officers is $549.10.The order did say just 6 instead of 2 apiece so he will have to refigure that.Ronnie showed the badge to the Council.Ron informed the Council that was the same design that will be the new door shields that they put on the new cars.Ron said the badge that they have had for awhile has been a shield badge.This style dates back to 1893.Instead of the 5-point star it has the circle behind 4 points of the star.It will be basically silver in color for the deputies and the marshals badge will be silver the 5 points and the outer rim will be gold.The silver badge is $30.00 apiece and the marshal badge is $39 or $40.

 

Mike Cornman recommended to the Council that we approve the new design of the Town Marshal badges.Gina Hawkins so moved.Donald Ashley seconded.Motion passed 5-0.

 

Darlene said she didnít know anything about the change.She wants some background on why the badge was changed.

 

Mike Cornman said the Council felt the need to change and the style of the badge for the department along with the image.The first thing was the badges.

 

Darlene said did you also change from police to marshals?

 

Mike Cornman said they never were---the badges always had the----- of the distention of chief and captain and stuff like that.Under Indiana law they are always Town Marshals and Deputy Marshals unless we adopt a metropolitan board of police commissioners.Technically anybody has a badge in a town that says chief or what ever really doesnít mean a thing except for internal and that was it.We want to get back to that.

 

Mike Cornman asked all in favor of the motion say aye and opposed say nay.Motion passed 5-0.

 

 

PART-TIME POLICE OFFICER:

 

Ron McGlocklin said they held interviews, he believe they interviewed 4 applicants.Ron and Sargent Humphrey did the interviews.Their final decision was Jeff Thomas, who is a Reserve Officer on our department.There was more discussion on this.

 

Ronnie said he believes he will be the best candidate for us, he is local and expressed interest in staying in this area.Jeff has been with the Reserves approximately 3 years.Jeff has done a very good job for us.

 

Mike Cornman asked is there a motion to appoint Jeff Thomas as Part time Police Officer?Donald Ashley said he will make the motion to appoint Jeff Thomas as our part time Police Officer.Patrick Stoffers seconded.Motion passed 5-0.

 

NEW BUSINESS:

 

UTILITIES AGREEMENT WITH INDOT:

 

Mike Cornman asked Mike Spencer if he got his message earlier today about the original?Mike Spencer said no.

 

Mike Cornman said we are a bit under the gun right now for one particular itís the large one so we can start relocating the water lines on 46.They need to be relocated between the railroad tracks and Hardees, the first phase of 46.You have looked it over is there anything in there that you could see, it is a standard State contract, right?

 

Rick Coppock said right, it is a standard State Contract and there are actually 2 of them.One is called some-------- agreement but it gives the State the right to use your easement or give your easement rights to them this is what the existing 12 inch water line is in right now it is in your own easement for that length of pipe through there.The other agreement is the utility relocation agreement, which the State is going to pay a percent on the relocation cost.Because of that you have your own easement so we are going to relocate the water lines which wonít be in a new easement it will be in the new highway right of way.The agreement is for a total of $814,700.It is not to relocate all the water lines between Smith Pike and railroad tracks but its to relocate those portions where there is a conflict with either the storm sewer or the relocation of sanitary sewer or when they redo the grade that the water line is to shallow, puts all new services in.It is pretty extensive it includes rock excavation.It includes stake out of the line and in----- the new lines, equipment rental, and everything required to construct the line, which will be constructed by the townís crews.

 

Mike Cornman said okay.What he would like to do is see if canít take a vote on this with no directive with further review of the Mike Spencer when he says everything is okay and if it is not we probably need to bring it back to the Council then.If it is okay as is he would like to see us approve those so we can get us going as soon as we can.His conversation with the project manager Tim Miller that we now are under, if we donít get it in real soon we will be one of the hold ups for the starting on time.He doesnít want that either.

 

Mike Farmer said he wants to be first in and first out.

 

Mike Cornman asked Mike Spencer how they should handle this?Mike Spencer said he thinks he has read that contract, when did you send it?Mike Cornman said shortly after the last meeting, he knows that, he thinks Tuesday or Wednesday.Mike Spencer said I have been there since.

 

Mike Cornman said I donít recall getting this.Mike Spencer said it may have not gone out.Mike Cornman said okay.

 

Mike Cornman said do you remember significant changes or just-?Mike Spencer said I donít believe there was significant changes.Mike Spencer said why donít you approve it subject to my comments so if he has problems with it then you hold it until the next meeting.Mike Cornman or a special meeting.

 

Mike Cornman said is there a motion to approve the 2 agreements currently on the table with currently with purposed with the Town of Ellettsville subject to the attorneyís approval.Is there a motion to that effect?Patrick Stoffers so moved.Donald Ashley seconded.Motion passed 5-0.Mike Cornman said we will get that wrapped up this week hopefully.

 

ORDINANCE 99-9 AN ORDINANCE OF THE ELLETTSVILLE TOWN CODE

Gina Hawkins read Ordinance 99-9.Diana said the money will just be sprit so it puts more money into the education, Law Enforcement.This will be the parking tickets that we get.

Mike Cornman said is there a motion to accept the first reading of Ordinance 99-9.Geraldine McIntyre so moved.Donald Ashley seconded.Motion passed 5-0.

 

NEW RESERVE OFFICERS: HARRY BOWEN:

 

Harry Bowen said he has 3 officers that have met the qualifications and the interviews of the Ellettsville Police Reserve.They have been through the 40-hour pre basic.Harry introduced them to the Council.They are Jacob Taylor, Tony Bowlen, and Ray Boylan.Upon exceptance they will be brought in as probationary officers to serve 6 months probation.They will have to ride with a senior officer.After that time they will be off probation and they will be able to act as a senior officer.

 

Mike Cornman asked is there a motion to bring these 3 gentlemen to probationary reserve officers.Gina Hawkins so moved.Donald Ashley seconded.Motion passed 5-0.

Mike Cornman read the request from Jim Ragle for over time pay.Mike Cornman said is there a motion to approve this request?Gina Hawkins so moved.Donald Ashley seconded.Motion passed 5-0.
