TO AMEND THE ELLETTSVILLE TREE ORDINANCE
BE IT ORDAINED AND ADOPTED by the Town Council of Ellettsville, Indiana:
Section 1. The following revision is hereby
made to Section 97.02 of the Ellettsville Town Code. When an existing section of the ordinance is
being amended, the text of the existing provision will appear in this style
type, additions will appear in this style type, and deletions will
in this style type.
§ 97.02 DEFINITIONS
For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
APPROVED STREET TREE LIST. The list of trees approved by the Town Council for planting within the public right-of-way or on public property.
PUBLIC PROPERTY. Property owned or controlled by the town.
PUBLIC RIGHT-OF-WAY. A strip of land occupied or intended to be occupied by a street or alley, boulevard, road, trail, transportation support facilities such as signs and signals, public utilities or other special public uses.
STREET TREES. Trees lying within
on the a) a public right-of-way owned or
controlled by the town , including those located in an area 15 feet in depth
from the pavement edge public right-of-way on either side of any paved through
streets within or b) any town owned or operated park or other public facility.
TOWN. The Town of Ellettsville.
TREE. A perennial woody plant, with one main stem, or in clump form up to three main stems, which develops many branches and ordinarily grows to a height of 20 feet or more.
SHRUB. A woody plant that is characteristically below 20 feet in height and is multi-stemmed supporting the main leafy growth.
URBAN FOREST. The collection of trees and shrubs located within the town limits.
VEGETATION. All herbaceous and woody plant material, including turf grass, vines, groundcovers, flowers and all other plant material not considered to be a tree or shrub.
Section 2. This ordinance takes effect following passage.
This ordinance was passed and adopted by the Town Council of Ellettsville, Indiana, at the Ellettsville Town Hall, Ellettsville, Indiana, on the ____ day of April, 2017.
