AN ORDINANCE REGARDING ANNEXATION OF

ADJACENT AND CONTIGUOUS TERRITORY

TO THE TOWN OF ELLETTSVILLE

 

NORTH CENTENNIAL DRIVE ANNEXATION

 

BE IT ORDAINED AND ADOPTED by the Town Council of Ellettsville, Indiana,

 

WHEREAS, the boundary of the Town of Ellettsville, Indiana, is contiguous to the real estate described herein;

 

WHEREAS, on April 24, 2017, Petitioner Centennial Park, LLC filed a Petition for annexation of property located at 4354 N. Centennial Drive, Bloomington, Indiana, requesting annexation of the area pursuant to Indiana Code 36-4-3-5.1;

NOW, THEREFORE, BE IT HEREBY ORDAINED AND ADOPTED BY THE TOWN COUNCIL OF ELLETTSVILLE, MONROE COUNTY, INDIANA, that:

 

Section 1. The following described land be, and the same is, hereby annexed to and declared a part of the Town of Ellettsville, Indiana, to-wit:

Address: 4354 North Centennial Drive, Bloomington, Indiana; Parcel No. 53-04-13-402-020.000-011

 

LEGAL DESCRIPTION-TRACT A

Lot 15 of Highland Park Estates Subdivision as recorded in Plat Cabinet B, Envelope 225, Office of the Recorder of Monroe County, Indiana, containing 0.57 acres, more or less.

AND

LEGAL DESCRIPTION-TRACT B

Part of the right-of-way in the cul-de-sac of Centennial Drive in Highland Park Estates Subdivision as recorded in Plat Cabinet B; Envelope 225, Office of the Recorder of Monroe County, Indiana, and more Particularly described as follows:

Beginning at an iron pipe found at the Southwest corner of Lot 15 of Highland Park Estates Subdivision; thence South 12 degrees 30 minutes 56 seconds West along an extension of the West line of said lot 50.00 feet to the center of the cul-de-sac; thence North 88 degrees 31 minutes 21 seconds East along an extension of the South line of said lot 60.00 feet to a corner of Lot 15 and to the beginning of a curve to the left with a radius of 50.00 feet and a chord of 61.57 feet bearing North 39 degrees 28 minutes 51 seconds West; thence Northwesterly along said curve and along the right-of-way line for Centennial Drive 66.33 feet to the point of beginning, containing 0.038 acres, more or less.

Commonly know as 4354 N. Centennial Drive, Bloomington, Indiana

 

Section 2. BE IT FURTHER ORDAINED that the boundaries of the Town of Ellettsville shall be, and the same are, hereby declared to be extended so as to include all of the real estate described above as part of the Town of Ellettsville, Indiana.

 

Section 3. Pursuant to I.C. 36-4-3-3, the above described territory, which is hereby annexed to and declared a part of the Town of Ellettsville, Indiana, shall be assigned to Council Ward 4.

 

Section 4. The above described territory, which is to be annexed to and declared a part of the Town of Ellettsville, Indiana, shall be assigned as follows: Parcel No. 53-04-13-402-020.000-011, is to be zoned R-1, single family residential.

 

Section 5. Pursuant to I.C. 36-4-3-7(a), this Ordinance shall be in full force and effect from and after its passage, promulgation, approval by the Town Council and thirty (30) days after final publication in accordance with the law.

 

This ordinance was passed and adopted by the Town Council of Ellettsville, Indiana, at the Ellettsville Town Hall, Ellettsville, Indiana, on the 2nd day of May, 2017.
